TERMS & CONDITIONS—CONTRACT

Return of Property: All vases and rental items must be returned to Vita Fiori in the same condition as they were delivered. In the event that any rental items are damaged, Client has one week to pay an invoice for the affected item(s). Client agrees to exercise due care in preserving the property of Vita Fiori. Client is responsible for all loss or damage to rentals, up to and including the replacement value of each missing or damaged item. Please inform guests to not take any rented items home.

Changes to Agreement: If anything changes outside of this agreement, such as venue, times, or locations, it is the Client's responsibility to notify Vita Fiori via email. Any changes to the event date or location must be made in writing and will be reflected in the portal. The value of the order may be reduced by no more than 20%, provided the total cost does not go below $6000. Any additional labor fees or new charges that arise due to timeline changes or increased item quantities will be the responsibility of the Client. Additions and changes may be made up until six weeks prior to the event date.

Deposit and Payments: A 25% non-refundable deposit is due at the signing of this contract. If the deposit has not been paid, Vita Fiori may accept another event on the Client’s date and will no longer be available. The remaining balance is due on or before the due date(s) specified. If payment is not made one month before the event, Vita Fiori reserves the right to cancel the contract.

Pricing Adjustments: In the event of unforeseen circumstances, such as natural disasters, pandemics, or significant cost increases, Vita Fiori reserves the right to adjust pricing to reflect increased costs or modify the scope of floral designs while maintaining the agreed-upon price. Vita Fiori will notify the Client of necessary adjustments at least six weeks prior to the wedding date.

Flower Quality and Substitutions: Flowers are live products and may vary in quality, appearance, and color. If a specific flower variety is unavailable or not suitable, Vita Fiori reserves the right to substitute flowers of similar aesthetic and value.

Artistic Integrity: Vita Fiori will not recreate exact arrangements shown in photos, magazines, or proposals due to artistic copyright laws. The integrity of the color scheme will be maintained, and flowers of equivalent value will be used.

Flower Care: Once flowers are delivered, Vita Fiori is not responsible for the condition of the flowers. It is the Client's responsibility to follow care instructions, such as keeping bouquets in water.

Alterations by Client: Clients or guests are not permitted to alter or change the design of any floral product provided by Vita Fiori. If a design is altered without consultation, a $600 fine will be imposed, and the Client agrees to pay this fine.

Copyright of Documentation: All documentation provided by Vita Fiori is copyrighted and cannot be shared with third parties without written consent, excluding the Client’s wedding planner.

Use of Photos: Vita Fiori reserves the right to use photos or videos from the event for promotional purposes, whether taken by the Client’s photographer or Vita Fiori’s own team, unless otherwise agreed upon prior to the contract signing.

Exclusive Floral Provider: Vita Fiori will be the only floral provider. Any other flowers brought to the event by the Client or third parties will result in a $600 fine. The Client agrees to this fine. (Flower girl petals may be provided by a third party.)

Team Handling of Setup: While Vita Fiori is committed to delivering the highest quality service, the Client understands that Johannah may not personally be on-site for event setup and execution. A trained team will handle the floral installation and deliveries.

Liability Limitations: Vita Fiori is not responsible for any damage to the flowers after delivery, including damage caused by extreme weather. Vita Fiori’s liability shall not exceed the total compensation received under this Agreement.

Force Majeure: Vita Fiori is not responsible for unforeseen events beyond its control, including natural disasters, pandemics, or acts of government. In such cases, the Client agrees that Vita Fiori’s liability will be limited.

Contract Understanding: The undersigned has read and fully understands the terms of this contract and agrees to be bound by them. Any changes must be made in writing and approved by all responsible parties. It is understood that Vita Fiori is the same entity as En Train de Bloom due to the rebrand.
